The site www.rev-fc.com was edited by REV.FC, a simplified joint-stock company with a capital of 10,000 euros whose registered office is 19-21 Rue Chapon 75003 Paris, registered in the Paris Trade and Companies Register under the number 907 752 166 operator of the site and owner of the registered trademark REV.FC (email: contact@rev-fc.com).
These Terms & Conditions (the "T&C") define the contractual relations between REV.FC, manager of the e-shop (hereinafter referred to as "the website" or "REV.FC") and the users of the site. (herein after referred to as “customers”).
Any purchase of a product on the website requires consultation and prior acceptance of the T&C applicable on the date of the order.
At any time, REV.FC may be required to modify some of the provisions of the T&C. The changes are then applicable from the posting of the new T&C. Consequently, the customer must take note of the applicable version of the T&C on the day of his order on the website.
The T&C are the only applicable conditions; they replace all other conditions, except with the prior express written consent of REV.FC
PRODUCTS
All REV.FC creations are unique, designed for each customer, according to their size and choice of colors (according to the choices offered on the website).
ORDERS
To place an order on the website, any customer undertakes, when registering, to provide exact information as to his identity, delivery, and billing address to allow REV.FC to ensure the sending of his order. It also undertakes to update any modification concerning this information.
Before finalizing his order, the customer must specify his choice of size and his choice of color. Once this information has been entered, the customer clicks on "Add to basket" and goes to the basket to finalize and pay for the order.
REV.FC considers that by validating his order, the customer has duly taken note of the T & Cs and accepted them without reservation. In addition, by validating these general conditions of sale, the customer declares to have the legal capacity allowing the conclusion of a contract within the meaning of the provisions of the Civil Code. The validation of the order and its taking into account will only be effective upon receipt of the full price of the product (s) ordered.
PRICE
The price of the products is that in force on the date of the validation of the order by the customer.
The prices displayed are indicated in euros all taxes included according to the VAT applicable on the day of the order.
The prices displayed do not consider the delivery costs which are indicated before the confirmation of the order and invoiced in addition.
REV.FC reserves the right to modify the prices of its products at any time and without notice, without this applying to orders in progress.
The information and in particular the prices displayed on the website may be incorrect due to system errors or typographical errors. If we do our best to avoid these kinds of mistakes, they can still exist. We do not honor orders based on incorrect information or prices. If the price displayed is lower than the actual price of the product, we will contact you by email to either cancel the order or give you instructions for paying the price difference.
PAYMENT
Payment of the full price of the products ordered must be made when ordering by the customer. REV.FC reserves the right to suspend or cancel any order and / or delivery in the event of non-payment.
You can pay for your orders by credit card (Visa, MasterCard, American Express or Carte Bleue). The amount of your order is then debited when the order is placed. The date of registration of the order is that of the online payment. Payment on our side is made through the Stripe payment app.
DELIVERY
Each piece is made to order, the tailoring time can vary from 7 to 14 days depending on the number of orders and the workload. At the end of this period you will receive a shipment confirmation email with a tracking number. If you have not received an email, contact customer service by sending an email to contact@rev-fc.com.
The products are shipped by Colissimo, via the Post Office (EU and rest of the world), and delivered to the address indicated by the customer when placing the order.
The customer is responsible for picking up his order. The risks of loss or damage to the products are transferred to the customer at the time he takes physical possession of the product, or a third party designated by him.
REV.FC cannot be held responsible for lost or damaged products, in the event of late delivery or packages noted by the delivery person as having been delivered but which the customer has not recovered.
In the event of an order to a country other than mainland France, the customer alone is liable for any customs duties, import duties or any other tax payable.
RIGHT TO RETRACT
As all REV.FC creations are unique and designed at the customer's request, the products offered on the website are considered "made according to the consumer's specifications" within the meaning of the provisions of article L. 221-28 of the French Code of consumption.
Consequently, any customer placing an order for a product on the website cannot exercise his right of withdrawal after purchasing his product and REV.FC will not issue any refund in this regard.
GUARANTEE
The products benefit from the legal guarantee of conformity provided for in Articles L. 217-4 et seq. Of the Consumer Code or the warranty against hidden defects provided for in Articles 1641 to 1649 of the Civil Code.
In the event of a proven defect or hidden defect in a product, the customer benefits from an exchange or refund guarantee provided that the said defect has been notified to REV.FC by e-mail as soon as it appears to contact@rev-fc.com.
Defects or defects which result from:
- abnormal or improper use of the product
- normal wear or aging of the product
- abnormal or non-compliant maintenance of the product
- an accident or an external cause falling within the remit of a third party
- poor customer measurement
- the actual appearance of the fabric (the photo of the product on the website is not contractual)
The cost of returning products for which the guarantee is requested are fully payable by the customer. The website www.rev-fc.com cannot be held responsible for lost returns, the shipment must be made by registered mail with acknowledgment of receipt or by any other means making it possible to ensure the effective delivery of the product to REV.FC .
INTELLECTUAL PROPERTY
The elements reproduced on the website are the exclusive property of REV.FC and are protected by copyright and trademark law. Any reproduction, distribution, modification, adaptation, retransmission, or publication, even partial, is strictly prohibited without the express written consent of REV.FC. Failure to comply with these rules constitutes an infringement punishable by the intellectual property code and exposes offenders to legal proceedings.
PERSONAL DATA
The personal data provided by the customer when ordering is necessary for the processing and execution of the order. Otherwise, the order cannot be processed.
The personal data thus collected are processed and stored by REV.FC in accordance with the provisions of the Data Protection Act of 6 January 1978 relating to the protection of personal data and the General Data Protection Regulations.
The customer has the right to access, interrogate, rectify, and delete information concerning him by contacting: contact@rev-fc.com.
The computerized processing of personal data collected is for the purpose of order management and re-use for commercial purposes for REV.FC only. If the Customer does not want their contact details to be used for commercial purposes, they must inform REV.FC by sending an email to the above address.
The personal data entered for the payment of the order and collected by Stripe are processed and stored by Stripe under its responsibility (for more information on the processing of data by Stripe, go to https://stripe.com/fr / privacy).
APPLICABLE LAW - DISPUTE RESOLUTION
The T&C will be governed by French law.
In the event of a dispute relating to an order, the customer is invited to contact REV.FC customer service by sending an email to contact@rev-fc.com. The parties will then seek to reach an amicable agreement.
If no agreement is reached, then a free mediation procedure will be offered.
Failing agreement at the end of the mediation, the dispute will be submitted to the competent French courts.
